Ana de Armas Fans Sue Universal Studios for cutting her out of ‘Yesterday’

Two Ana de Armas fans are suing Universal Pictures for allegedly duping them into renting a film because trailers and advertising material led them to assume she would be in it.

Conor Woulfe of Maryland and Michael Rosza of California claim in their lawsuit that they paid $3.99 apiece to rent the film on Amazon Prime and then learned that De Armas did not feature in the film, titled Yesterday, despite her appearance in the trailer they saw on the streaming service in October 2021.

They are suing for $5 million in damages on behalf of all impacted customers, claiming that the corporation distributed “false, deceptive, and misleading advertising” for the film, according to court records.

“Because consumers were promised a movie with Ana De Armas by the trailer for ‘Yesterday,’ but did not receive a movie with any appearance of Ana De Armas at all, such consumers were not provided with any value for their rental or purchase,” the lawsuit claims.

They stated in their complaint: “Although Defendant (Universal) included the scenes with Ms de Armas in the movie trailer advertisements, for the purposes of promoting Yesterday and enticing film sales and rentals, Ms de Armas is not and was never in the publicly-released version of the movie.

According to the suit, de Armas, who just participated in the latest James Bond film, is “famous throughout America and the world because of her successful movie and other media appearances.” The plaintiffs argue that Universal used de Armas’ “fame, radiance and brilliance to promote the film by including her in scenes in the movie trailers advertising “Yesterday.””

De Armas was meant to play Roxanne, one of the main character’s love interests. She was going to be in a love triangle with Patel and James, but test audiences didn’t like it. “That was a very traumatic cut because she was brilliant in it. I mean really radiant,” screenwriter Richard Curtis told CinemaBlend in 2019, “And [that] turned out to be the problem.”

Yesterday tells the story of an ambitious musician who wakes up in a world where no one remembers The Beatles ever existed, except for him. As a result, he starts misrepresenting their music as his own and becomes an overnight superstar.

The lawsuit bears resemblance to a Michigan case from 2011 involving the Ryan Gosling film “Drive.” The plaintiff claimed that the film’s promotional materials suggested it would be “a chase, race, or high speed action driving film” comparable to “The Fast and the Furious.” According to the plaintiff, the teaser neglected to show that the film had “many segments of slow paced, interpersonal drama,” with graphic violence. The lawsuit was rejected by an appeals court in 2013.

Ana de Armas will star in three films this year: the psychological thriller Deep Water, the action thriller The Gray Man, and the biopic drama Blonde.
