Jussie Smollett sentenced to 150 days in jail for That Fake Attack

After a jury found him guilty of lying to police about being the victim of a hate crime, Jussie Smollett was sentenced to 150 days in prison.

In December, the homosexual African American 39-year-old was tried and convicted of “planning” the false attack by paying two Nigerian brothers $3,500 and of lying to police in his depositions.

Before being brought from the courthouse, Smollett vehemently maintained his innocence and said he could be murdered in jail.

The punishment also includes 30 months of probation and restitution and penalties totaling $145,000 (£110,000).

Smollett lowered his face mask and stated he was innocent after the judge pronounced his punishment. “Your honor, I respect you and I respect the jury, but I did not do this,” the actor said to the judge before turning to the audience. “And I am not suicidal. And if anything happens to me when I go in there, I did not do it to myself. And you must all know that.”

Smollett yelled again as he was escorted out of the courthouse by cops.

He screamed, raising his fist, “I am innocent! I could have said I am guilty a long time ago.”

Smollett, 39, the former star of “Empire,” was found guilty of five counts of felony disorderly conduct by a Chicago jury in December. The sixth accusation, aggravated battery, was ruled not guilty.

The case came from a three-year-old incident in which Smollett said he was attacked by two people.

He said that two guys assaulted and kicked him, screamed racial and homophobic comments, sprayed a chemical in his face, and tied him up.

Authorities launched an investigation, but Smollett was charged with filing a fake police complaint in February of that year, stating he orchestrated the incident.

Last year, a jury of six men and six women heard testimony from brothers Abimbola and Olabinjo Osundairo, who alleged that Smollett paid them $3,500 to plot and carry out the assault.

Before pronouncing Smollett’s punishment, Cook County Judge James Linn spoke for more than 30 minutes, telling the actor that he authored the screenplay and chose the actors for the hoax, and that his premeditation for the conduct was a “aggravating factor” in the case.

“There’s a side of you that has this arrogance, and selfishness and narcissism that’s just disgraceful,” the judge stated, referring to the judge’s arrogance, selfishness, and narcissism. “You’re not a victim of a racial hate crime, you’re not a victim of a homophobic hate crime. You’re just a charlatan pretending to be a victim of a hate crime, and that’s shameful.”

When sentencing Linn for his conviction on five counts of disorderly conduct, special prosecutor Dan Webb requested Linn to add “an appropriate amount of prison time.”

After the hearing, Webb stated, “His conduct denigrated hate crimes. His conduct will discourage others who are victims of hate crimes from coming forward and reporting those crimes to law enforcement.”

Attorneys for Jussie Smollett indicated they will file an appeal. Linn turned down petitions to have the sentence stayed or put on hold while an appeal was being conducted.

“I’m not staying this. This happens right here, right now,” Linn explained.

Smollett’s siblings expressed disappointment at the sentencing, and several took issue with the judge’s remarks.

“I did not expect him to be completely lenient and listen. But at the same time, he shamed my brother,” said Smollett’s older brother, Jojo Smollett. “He spoke about his arrogance. He doesn’t know the struggles my brother is encountering. He doesn’t know anything that he’s dealing with.

Following the sentencing, Gloria Rodriguez, an attorney representing the Osundairo brothers, made a statement.

“The Honorable Judge Linn found the Osundairo Brothers not to be criminally connected to Mr. Smollett’s crime in any way, and for anyone continuing to state otherwise simply does not understand the laws or facts in this case,” she stated. “Nevertheless, the Osundairo Brothers regret their role in the case and hope that the sentence today brings closure to the affected people of Chicago. They look forward to telling their story in detail in the very near future.”

After the event, Smollett’s acting career came to a halt. In the last season of Empire, a Fox television hip-hop drama, he lost his position as a singer-songwriter.

In a scathing statement Thursday night, Chicago Mayor Lori Lightfoot hailed the decision, saying Smollett’s conviction and punishment send a clear message “that false claims and allegations will not be tolerated.”

“The malicious and wholly fabricated claim made by Mr. Smollett resulted in over 1500 hours of police work that cost the City over $130,000 in police overtime,” she continued. “The City feels vindicated in today’s ruling that he is being held accountable and that we will appropriately receive restitution for his actions.”
